Terms of Service for Post Doctoral Dental Studies Institute, a not for profit organization
Welcome to The Post Doctoral Dental Studies Institute NPO(“PostDDS”) website (the “Site”). PostDDS owns and operates the Site and the documents and other content available on the Site (“Site Content”) are protected by copyright laws throughout the world. PostDDS grants you a limited license to use the Site subject to the terms and conditions of service (“Terms of Service”) set forth below. By using the Site, you agree to follow and be bound by the Terms of Service. We may revise the Terms of Service (on a going-forward basis only) at any time without notice.
Areas of the Site may have different terms of service posted. If there is a conflict between the Terms of Service and other terms and conditions posted for a specific area of the Site, the latter shall have precedence with respect to your use of that area of the Site.
Our services are available only to dental hygienists, dental assistants, and laboratory technicians or those with a D.D.S. or D.M.D. degree or foreign equivalent (each, a “Student”). If you do not qualify, please do not use the Site.
Fees for each course are based on the number of credit hours, unless otherwise indicated on the Site. Fees for each course must be paid prior to enrollment and are nonrefundable and nontransferable, except that PostDDS will refund fees for courses canceled by PostDDS after a Student has enrolled. No refunds or credits will be given for non-passing grades. Credit hours once purchased must be used within twelve (12) months. Fees do not include any applicable sales, excise or other taxes. All fees are subject to change without notice.
Course size is limited and courses are available on a first-come, first-serve basis through the registration procedure provided on the Site. Courses are offered during stated time periods, and lessons must be completed within those times. No make-up courses or refunds are offered for missed attendance.
PostDDS reserves the right to add or remove courses from its curriculum without notice and to cancel courses for which an insufficient number of Students have registered.

5. Intellectual Property License For Site Content
PostDDS grants each Student a nonexclusive, nontransferable personal license to display and print Site Content for his or her own personal educational use and not for further dissemination to others. Access to a particular course may be restricted to Students who have registered for the course and paid the applicable course fees in advance. Students may not circumvent the Site’s access control measures. Each course registration entitles only one (1) Student to access the course. Students who have registered for a course may not share their access to the course with others. PostDDS will award non-passing grades to Students who violate these Terms and Conditions. Site Content may not be modified or altered in any way. No other use of the information is authorized without express written consent of PostDDS. Students must not remove any copyright or other proprietary rights notices on the Site.
Content Changes; Third Party Web Sites and Services
PostDDS reserves the right to change or discontinue the Site or any Site Content at any time, with or without notice, and with no liability to Students beyond refund of unused credit hours. The Site may include hyperlinks to web sites not controlled by PostDDS and access to other content, products and services from third parties. PostDDS is not responsible for any content, products or services provided by third parties, including content on those web sites to which it provides links. PostDDS provides these links merely as a convenience and the inclusion of such links does not imply an endorsement. Students agree that PostDDS is not responsible for any loss or damage of any sort they may incur from dealing with any such third party.
7. Academic Policy
Certain courses have prerequisites which PostDDS may waive for Students who successfully complete a pre-course examination. No grades or credits will be awarded for passage of a pre-course examination. Passage of a pre-course examination does not signify attainment of all aspects of prerequisite course. Grades for post-course examinations shall be awarded in accordance with the sole discretion and judgment of PostDDS, whose decisions will be final.
8. Accredited Status
PostDDS is currently an approved PACE program provider. PostDDS makes no warranty or representation that such status will continue in the future or that courses provided on the site will fulfill Continuing Dental Education (“CDE”) requirements of any particular jurisdiction or organization. Submission of course completion vouchers to credentialing agencies such as the national, state or local authorities or associations are the responsibility of the student. PostDDS does not certify any Student’s competency to practice dentistry and Students may not hold themselves out to the public has having been credentialed or approved in any way by PostDDS.
The site is funded by subscribers. No advertising is accepted or hosted until further notice. All health related content is authored by medical/dental professionals whose credentials are listed, some health related information, not attributed to the author, may appear as references in links or in bibliographies cited by authors.
EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE, THE SITE, AND ALL CONTENT, MATERIALS, INFORMATION, SOFTWARE, PRODUCTS AND SERVICES PROVIDED ON THE SITE, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WHILE SITE CONTENT IS COMPILED FROM SOURCES BELIEVED TO BE RELIABLE AND ACCURATE, POSTDDS MAKES NO WARRANTY REGARDING THE ACCURACY OF SITE CONTENT. POSTDDS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. POSTDDS MAKES NO WARRANTY THAT: (A) THE SITE WILL MEET STUDENT REQUIREMENTS; (B) THE SITE WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS; (c) APPLICATION OF THE USE OF THE SITE CONTENT WILL RESULT IN SUCCESSFUL TREATMENT; OR (D) PERSONS PASSING A COURSE ON THE SITE WILL HAVE ANY COMPETENCY WITH RESPECT TO ANY ASPECT OF DENTISTRY, INCLUDING THE SUBJECT MATTER OF THE COURSE.
SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
10. Limitation of Liability
IN NO EVENT SHALL POSTDDS OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR USE, INCURRED BY ANY STUDENT WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM STUDENT ACCESS TO, OR USE OF, THE SITE, WHETHER OR NOT POSTDDS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN PARTICULAR, POSTDDS WILL HAVE NO LIABILITY FOR RESULTS OBTAINED BY STUDENTS IN THE PRACTICE OF DENTISTRY. POSTDDS’ TOTAL CUMULATIVE LIABILITY TO ANY STUDENT, WHETHER IN AN ACTION IN CONTRACT, IN TORT OR OTHERWISE, WILL NOT EXCEED THE FEES PAID BY SUCH STUDENT FOR THE COURSE OR COURSES GIVING RISE TO LIABILITY. THIS LIMITATION SHALL NOT BE EXPANDED BY MULTIPLE CLAIMS.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
11. Resolution of Disputes
In the event a dispute arises between Students and PostDDS, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Before resorting to litigation, PostDDS strongly encourage Students to first contact us directly to seek a resolution.
12. Choice of Law; Venue
All matters relating to Student access to, and use of, the Site and these Terms of Service shall be governed by the laws of the State of Michigan, without reference to any choice of law provisions. Any legal action or proceeding relating to Student access to, or use of, the Site shall be instituted in a state or federal court in Wayne County, Michigan and no other venue. Students and PostDDS agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
